Strasbourg, May 6 2009 − The debates on the Telecoms Package, thanks to a remarkable citizen mobilization, led to an extremely strong recognition of the access to internet as a fundamental right with the re-adoption of amendment 138/46 in second reading by a qualified majority. It is the final blow against three-strike laws such as Nicolas Sarkozy's HADOPI bill, which are explicitely banned. The European Parliament nevertheless adopted a soft compromise on issues of network equity: no strong protection against “net discrimination” was adopted.
La Quadrature warmly thanks the numerous European citizens who have contributed to the possibility of this new and stronger than ever statement for fundamental rights. Even on issues connected to network offers, the worst provisions introduced since the beginning of the legislative process were not adopted. Thanks to the public debate, the ill-intended co-operation between ISPs and right holders and discrimination of Net services and contents will not be forced, even though doors are still open for introducing it in Members States.

The massive re-adoption of amendment 138/462 rather than the softer compromise negotiated by rapporteur Trautmann with the Council is an even stronger statement. These two elements alone confirm that the French ‘three strikes’ scheme, HADOPI, is dead already.” explains Jérémie Zimmermann, co-founder of La Quadrature du Net.
To safeguard these provisions, the European civil society will have to be strongly mobilized during a conciliation phase3 that would proceed with a newly elected Parliament and a new Presidency. Furthermore, some provisions in the compromise amendments to the Harbour directive adopted today allow telecoms operators to alter the Internet as we know it. Nothing will forbid them to turn the Internet away from a neutral zone where people have equal access to all content applications and services.
As these provisions have been negotiatied with the Council, they are likely to become law. Citizens will have to be particularly attentive to the transposition and implementation of the adopted provisions. It would be disastrous for the Internet to stop being a space where all can create innovative services and contents without permission from gatekeepers. In order for consumers to be in a position to endorse equitable network offers and reject the discriminatory offers, it is essential for at least some of the offers to be non-discriminatory. We will call the regulatory authorities and the Commission to ensure it by all policy means.

Unfortunately, on issues that appear more technical such as the absence of discrimination of services and contents on the Internet, the Parliament did not take the full measure of what it is at stake yet. “Internet è un eccezionale strumento di circolazione delle opere e la SIAE non vuole in alcun modo ostacolare la libera diffusione delle stesse. Presso la SIAE è istituito un apposito registro delle opere musicali che potranno essere utilizzate anche gratuitamente su Internet secondo le indicazioni dei rispettivi autori” - lo ha dichiarato oggi il Presidente della SIAE Giorgio Assumma in apertura dei lavori del Forum “Diritto d’autore, web e pirateria” organizzato dalla SIAE e dall’Ars (Assemblea Regionale Siciliana), al Palazzo dei Normanni a Palermo. “L’autore - ha proseguito Assumma - che voglia concedere l’uso gratuito delle sue opere su Internet può chiedere alla SIAE di escludere dalla sua tutela i diritti relativi alle utilizzazioni di queste opere sulle reti telematiche e di telefonia mobile o di altre forme analoghe di fruizione delle opere “.

A Bruxelles si stanno ridefinendo le regole delle TLC; e' un passaggio necessario dettato dall'evoluzione tecnologica.
Una volta la voce e i dati stavano rigidamente discriminati (su reti diverse), mo' che finisce tutto nelle reti IP e che i dati offrono servizi che richiedono isocronicita' (ritardi costanti per i pacchetti nell'attraversamento delle reti), bisogna fare i conti con la limitazione delle risorse. Il gruppo automobilistico Porsche ha annunciato che si fonderà con Volkswagen, di cui è già azionista di maggioranza. The results of the government's stress tests on banks, to be released in a few days, will not mark the beginning of the end of the financial crisis. If we are to believe the leaks, the results will show that there might be a few problems at some of the regional banks and Citigroup and Bank of America may need some more capital if things get worse. But the overall message is that the sector is in pretty good shape.
This would be good news if it were credible. But the International Monetary Fund has just released a study of estimated losses on U.S. loans and securities. It was very bleak -- $2.7 trillion, double the estimated losses of six months ago. Our estimates at RGE Monitor are even higher, at $3.6 trillion, implying that the financial system is currently near insolvency in the aggregate. With the U.S. banks and broker-dealers accounting for more than half these losses there is a huge disconnect between these estimated losses and the regulators' conclusions.
Regulators have told Bank of America Corp. that the company needs to take steps to address a roughly $34 billion capital shortfall based on results of the government's stress tests, according to people familiar with the situation.
The exact amount of the needed infusion couldn't be determined late Tuesday, and Bank of America officials either declined to comment or couldn't be reached.
Regulators began notifying the 19 financial companies subjected to the government tests of the results Tuesday.
An official announcement is expected after the close of U.S. stock-market trading Thursday.
At Bank of America, the government's findings are likely to set off a scramble over how to fill the capital hole at the nation's largest bank in assets.
The Charlotte, N.C., bank already has received $45 billion in capital from the federal government, some of it to help the bank cover losses stemming from its purchase of securities firm Merrill Lynch & Co. in January.
